Subject to the foregoing provisions, the Department may make available to appropriate federal and state agencies information and material developed in the course of its hearings and investigations. In order to facilitate the making of investigations by the Department, in the interest of public safety and promotion of aeronautics, the public interest requires, and it is, therefore, provided that the reports of investigations or hearings, or any part thereof, shall not be admitted in evidence or used for any purpose in any suit, action or proceeding, growing out of any matter referred to in the investigation, hearing or report thereof, except in case of criminal or other proceedings instituted in behalf of the Department or this State under the provisions of this chapter and other laws of this State relating to aeronautics, nor shall the Secretary of Transportation, or any officer or employee of the Department be required to testify to any facts ascertained in, or information gained by reason of, his such person’s official capacity, or be required to testify as an expert witness in any suit, action or proceeding involving any aircraft. Amend § 141, Title 2 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows: (4) “Gender silent techniques” include substituting the nouns to which the masculine and feminine pronouns refer. (3) If the Revisors cannot determine how to apply paragraph (c)(1) of this section to masculine and feminine pronouns used in a law, the Revisors shall report this to the Director of the Division of Research for possible correction through the legislative process. (2) The Revisors shall apply paragraph (c)(1) of this section to all laws enacted on or after and may apply paragraph (c)(1) of this section to laws enacted before. (c) (1) The Revisors shall gender neutralize or otherwise insure use gender silent techniques to ensure that masculine and feminine pronouns are not used and shall ensure that a solely masculine or feminine designation never occurs unless it could only apply to one only when it applies to 1 gender.
